Richard Mdluli trial set for June

The trial of former police crime intelligence boss Richard Mdluli will be heard in June, the South Gauteng High Court, sitting in Palm Ridge, has ruled.

“A warrant of arrest has been issued for the accused [Mdluli] for June 1 next year,” Judge Tshifhiwa Maumela said today.

“The matter is postponed for purposes of trial.”

Mdluli was not in court today because he had had an operation, his lawyer Ike Motloung SC said.

He confirmed the date of trial and handed in a doctor’s note on behalf of Mdluli.

“General Mdluli has not been hospitalised, but booked off. He recently had a surgical operation,” Motloung said during the brief proceedings.

Mdluli’s co-accused, Mthembeni Mtunzi-Omhle Mthunzi, was in court.

Earlier this year, the Supreme Court of Appeal upheld a ruling by the North Gauteng High Court, which reinstated fraud and corruption charges against Mdluli in an order sought by Freedom Under Law.

Mdluli appeared on October 7, when the matter was postponed so the defence could be provided with documents.

He was suspended amid allegations of fraud and corruption, and charges relating to the murder of his former lover Tshidi Buthelezi’s husband Oupa Ramogibe in February 1999.

The fraud and corruption charges were withdrawn on December 14 2011 and Mdluli was reinstated as head of crime intelligence in March 2012.

A month later, the National Prosecuting Authority provisionally withdrew the murder charges, pending an inquest. In May that year, then police minister Nathi Mthethwa announced that Mdluli would be transferred from crime intelligence to the office of the deputy national police commissioner for operations.

Later, he was suspended for a second time when allegations emerged from the inquest into Ramogibe’s murder. In November 2012, the inquest cleared him of any involvement in the murder.

According to the charge sheet presented at a hearing in August, Mdluli went to extreme lengths between 1997 and 1999 to find out where Buthelezi and Ramogibe were hiding.

Mdluli had a long-term relationship with Buthelezi from school days and he claimed she was his wife.

However, during her relationship with Mdluli, Buthelezi met Ramogibe and they began a relationship. They married on July 22 1998.
