SCA reopens Hlophe case

The Supreme Court of Appeal this morning ordered the Judicial Service Commission (JSC) to reopen its investigation into alleged misconduct by Western Cape Judge President John Hlophe.

This comes after Freedom Under Law (FUL), an NGO led by Emeritus Archbishop Desmond Tutu and academic Mamphela Ramphele, appealed a judgment by the North Gauteng High Court, dismissing FUL’s application to reopen the Hlophe case.

FUL’s application came after the JSC concluded Hlophe’s visit to Constitutional Court judges who were hearing a matter concerning President Jacob Zuma’s corruption case did not constitute “gross misconduct”.

The JSC proceeded to treat the matter as “finalised”.

A full bench of appeal court judges have now dismissed this ruling, which in effect reopens the JSC’s hearing into Hlophe’s actions.
