State says it’s still murder even if Oscar mistook Reeva for intruder

The state has given short shrift to Oscar Pistorius’ contention that he mistook Reeva Steenkamp for an intruder.

The indictment, which was served on Pistorius in the Pretoria Magistrates’ Court this morning, states that even if his then girlfriend, Steenkamp, had been an intruder it would still be murder.

On the night Steenkamp was killed, witnesses at Pistorius’ upmarket Pretoria home heard a woman scream, “followed by moments of silence, then heard gunshots and more screaming”.

“The accused said to witnesses on the scene that he thought she was an intruder.

“Even then the accused shot with direct intention to kill a person,” the indictment reads.

It also confirms that the “deceased had locked herself in the toilet cubicle”.

A trial date has been set for March 3 and the matter has been transferred to the North Gauteng High Court.

Pistorius was supported by his siblings, Aimee and Carl, in the packed court this morning. They held hands and prayed in the tense minutes before Chief Magistrate Desmond Nair convened the hearing.

Pistorius sat hunched, in a black suit, and spoke in a thin voice.

Asked by Nair if he was well, Pistorius said in a soft voice: “Yes, under the circumstances.”

Nair then explained the matter was being transferred and asked if Pistorius was happy with his legal team.

“I’m satisfied with the preparations my legal team has made,” he said, before staring at the floor again.

The charge sheet confirms that Pistorius has only been charged with murder and the unlawful possession of 38 rounds of .38 ammunition.

The indictment also list all 107 witnesses that the state intends to call, including seventeen witnesses who are Pistorius’ neighbours at the Silverwoods Country Estate.

Also included on the list are Reeva’s friend and former housemate, Gina Myers, and Pistorius’ ex- girlfriend, Samantha Taylor.

Taylor’s mother insinuated that Pistorius had a violent nature, when she said on Facebook she was glad her daughter was out of his “clutches”.

The indictment confirms that Steenkamp had died of “multiple gunshot wounds” shortly after 3am on February 14.

Ian Levitt, representing Gina Myers, said after the hearing, “ironically today would have been Reeva’s birthday.

“Instead we’re in a court appearance related to her death.”

Pistorius’ bail conditions remain unchanged.
