Teacher wins defamation suit

An Eastern Cape teacher has won a R100 000-defamation claim following rumours that he had sex with a Grade 8 pupil.

“In my view the statement that he had sex with a student lowered his dignity; it injured him in his good name and it was therefore defamatory,” Magistrate Kholisani Mkhango said in the Mqanduli Magistrates Court.

“The allegation was not properly investigated and in the circumstances it was unfounded.

I am of the opinion that the proper route would have been for the principal to report the allegations to the department and not deal with the matter internally,” said Mkhango.

The Dispatch Online reported the Transkei teacher, Maseko Nobahambi, who had been teaching English at Ngcanasini Junior Secondary School since 1994, was accused of having an affair with a Grade 8 pupil in 2003.

The school principle, Moris Makaziwe Nokwali, locked him out of the school and also spread the rumour, causing Nobahambi to slap her and the education department with a R100 000 defamation suit.

Nokwali told the court that the Grade 8 pupil said she was having an affair with the teacher and that she was too afraid to attend school.
