Zuma’s cavalier attitude an insult

The golden thread that runs through the Supreme Court of Appeal’s judgment in the case brought by the DA against the appointment of Menzi Simelane as the National Director of Public Prosecutions is this: we have a president who is indifferent to the rigours required for the office he holds.

At face value, the case may appear to be about the suitability of Simelane to hold the office but, in fact, it is an indictment on the president’s cavalier attitude to how he should­ exercise the enormous powers he holds.

The president ought to have had regard of the fact that Simelane was, at the very least, a controversial appointment. As such, he should have first satisfied himself that the allegations against Simelane were objectively proven to be insufficient for him not to appoint Simelane to such an important office.

The minister of justice and constitutional development must also account for ignoring concerns raised by the Public Service Commission.

As it turned out, indifference did not make the matter go away.

The president and the minister have therefore done themselves and, more seriously, the office of the National Director of Public Prosecutions a disservice by ­forgetting that ours is a regime founded on accountability and rule of law.
