Assault: arrest warrant issued after local man ducks court

A WARRANT of arrest was issued by a Pietermaritzburg magistrate yesterday for Prestbury resident Xolani Emmanuel Ndlovu (30), who faces two charges of assault arising from an incident in which he allegedly threatened to shoot a police constable and another person.

It is believed that Ndlovu is the owner of Bha’s Car Wash, which featured in a Witness article published in December.

It was later confirmed by police spokesperson Joey Jeevan that Ndlovu was arrested on March 23 last year in connection with allegations of assault and other charges, including “obstructing a police officer in the course of his duties”.

He was expected to go on trial yesterday, she said.

When the case was called shortly before lunchtime yesterday, Ndlovu failed to appear.

His legal aid attorney, U. Debisingh, confirmed he had not seen his client earlier that day.

When Ndlovu did not respond to his name being called in the corridors, prosecutor Nangamso Goloda asked magistrate C. Zungu to issue a warrant for his arrest.

He said Ndlovu is out on warning and that he had been informed by the court at his previous appearance that he had to appear for trial yesterday.

According to the charge sheet, Ndlovu faces two counts of assault arising from an incident on March 12 last year when he allegedly told police constable Thukisizwe Zibula and another man, Skhumbuzo Magwenyana, that he would “assault and shoot” them, causing them to believe he would carry out his threat.
