THE trial of six murder accused was delayed as one accused’s legal aid attorney did not receive statements in time and because the accused intend to plead guilty. They are accused of the murder of Naushad Mohamed (23) who was allegedly hit with a baseball bat and shot in the chest during a brawl at G’s Cafe in Raisethorpe last year.
Adrian Muthusamy, Deon Maharaj, Leona Naidoo, Kurt Naidoo and two juveniles, all of Copesville, are also charged with the assault of Yubendran Lutchman and Jonathan Govender, and with the unlawful possession of a .9 mm pistol.
Prosecutor Mfundo Phephu told the Pietermaritzburg regional court that the legal aid attorney had received the statements late and had consulted the accused only yesterday.
He added that the accused intend to plead guilty to the charges and asked the court to adjourn the matter to allow the accused to consult with their legal representatives.
Arnold Mahlobo, for Muthusamy, only viewed the CCTV footage in court yesterday and needed to consult with his client. The matter will be back in court on May 3.
