Claim: mother sues Ulundi for shock to son

A MOTHER has instituted a claim against Ulundi Municipality for R2 150 000 in damages suffered by her young son who was shocked and badly injured by an electrical distribution/transformer unit near their home. The claim, which is being opposed, has been lodged in the high court in Pietermaritzburg by Doreen Nzimande on behalf of her son, Solomuzi, who was born on August 28, 2002.

At the time of the incident, on February 26, 2007, he was just four years old. According to the court papers, Solomuzi suffered severe burns and is said to be permanently scarred and disfigured. Court papers allege that — knowing the risks posed by the live electrical unit in a residential area — the municipality had a duty to take precautions to prevent any unauthorised access to the unit, but had allegedly failed to do so. The case was postponed for further documents to be filed.
