Cop jailed for sex with prisoner

AN orderly at the Pietermaritzburg Magistrate’s Court was sentenced to 10 years in prison for corruption and sexual assault on Friday.

The court found Sergeant Thomas Mdunyiswa Nzimande (54) had sex with an awaiting trial prisoner, promising to have the case against her withdrawn if she agreed.

The sexual assault happened when he was taking the victim to Westville prison in 2010.

Magistrate Mpume Linda said Nzimande had violated trust of his victims as a police officer.

“The victim felt belittled and did not know what to do. They felt that the police won’t even help them as they were victimised by the police. She had lost faith in the police.”

Linda said being a police officer used to be an honourable job, that the citizens of this country used to respect and trust. “If anyone taints this honourable job, they need to be punished to refrain other from committing the same offences.”

She added that society ended up losing trust in the police as a result of individuals like Nzimande.

However, Linda added that the complainant in the corruption case is also not innocent, as she was going to benefit from Nzimande if the charge was withdrawn.

She then sentenced him to 10 years’ imprisonment for corruption and seven years for sexual assault, to be served concurrently.

In a separate case in the Pietermaritzburg Magistrate’s Court on Thursday, a policeman was sentenced to a R2 000 fine or one year in jail for assault with intent to commit grievous bodily harm.

Constable Lindo Sibonelo Zuma (28) from Glenwood in Pietermaritzburg, was sentenced for shooting Lunga Duma in the foot in Imbali on December 2010.

He also received a suspended sentence on condition that he is not convicted of a similar offence. He was found to be unfit to possess a firearm.
