Cops threatened to hit me — boy accused of rape

A BOY aged 14 who is charged with his older brother and another man with gang rape and the murder of a 14-year-old girl in the Mountain Rise cemetery on July 30 alleged yesterday that police threatened to assault him unless he pleaded guilty to the charges.

He alleged police had “pulled” various parts of his body, including his nose and eyebrows and threatened to hit him if he did not plead guilty.

Pietermaritzburg magistrate Paul van Dongen advised the youngster to consult his attorney about the allegations.

The teenager — who looked even younger than his age recorded on the charge sheet — was joined in the dock for the first time yesterday by his 17-year-old brother.

The two juveniles and their 20-year-old co-accused, who cannot be named until he has pleaded to the rape charge facing him, are charged with the gang rape and murder of Mabongile Xaba and of stealing her cellphone on the day in question.

The 17-year-old youth faces two additional charges of murder and robbery arising from an incident in which a man, identified only as “Rasta” on the charge sheet, was stabbed to death and robbed of his cellphone in Balhambra Way on November 5.

The father of the brothers was present at yesterday’s court hearing.

He asked the court to appoint a legal aid attorney to represent them.

State prosecutor Sally Singh said the state was opposed to bail being granted to all three accused.

The case was postponed to January 9 for a formal bail application.
