Fake deed case drags on longer

THE couple convicted of fraud relating to the ownership of a house managed to delay their sentencing further yesterday, saying they wanted to call more witnesses and apply for the recusal of the presiding officer.

This resulted in another postponement of the case involving Akashnee Singh and Dinesh Lutchman.

They want magistrate Chris van Vuuren to recuse himself, claiming he is biased and they feel that he is influenced by their previous conviction for fraud.

The couple represented themselves in yesterday’s proceedings and told the court that they would call attorney Viren Naidoo and others to testify for them.

They also claimed they were unfairly treated because the magistrate was always angry.

Van Vuuren said the accusations were unfounded.

The grounds for the application are unclear, apart from a general allegation that they allege the magistrate was biased.

Van Vuuren postponed the matter until tomorrow for them to bring affidavits and their witness.

The pair were convicted of fraud for presenting fake documents to an attorney in a bid to take transfer of the house they were renting from Rowena Padayachee.
