Fake deed: couple apply to appeal

SENTENCED fraudsters Dinesh Lutchman and his wife, Akashnee Singh, have lodged an application for leave to appeal against their convictions and jail sentences.

They were found guilty last year of defrauding Rowena Padayachee of her house in Burger Street by presenting a fake deed of sale to an attorney in a bid to take transfer of the property, which they were renting at the time. They were also found to have presented other false documents to the municipality to secure lights and water in their name.

The accused remained in the house pending the outcome of the trial — a period spanning almost eight years. Padayachee obtained an eviction order against them in the high court last year but the couple later lodged an appeal against that ruling.

In December regional magistrate Chris Van Vuuren sentenced the couple to eight years’ imprisonment, of which half was suspended conditionally.

They have started to serve their jail sentences. They appeared before him this week to lodge their application for leave to appeal. The hearing was adjourned to March 30.
