Faked deed case moved 13th time

A DELAY in obtaining a typed record of the trial of convicted fraudsters Akashnee Singh and Dinesh Lutchman resulted in another postponement of the case yesterday.

The couple, represented by attorney Viren Naidoo, have instructed him to bring an application for the recusal of the presiding regional magistrate in the case, Chris van Vuuren.

The grounds for the application are unclear, apart from a general allegation that they allege the magistrate was biased.

The couple were convicted of fraud for presenting fake documents to an attorney in a bid to take transfer of the house they were renting from Rowena Padayachee, who testified that she had never signed a deed of sale or considered selling the house which she inherited from her mother.

Naidoo said yesterday an advocate has been briefed to argue the application for the magistrate’s recusal and requires a full transcript of the trial record to prepare.

He gave the court letters sent to the company responsible for typing the record, which made it clear that the transcript was needed urgently.

He said he was told yesterday it would take another seven days for the record to be typed.

Van Vuuren said that in this instance the defence could not be blamed for the further delay.

He noted, however, that the case has been adjourned 12 times since the accused were convicted on August 8.

The case was adjourned to December 15.
