Father on bail in daughter rape case

A 43-YEAR-OLD man from Haniville who is charged with raping his six-year-old daughter more than once during January was yesterday granted bail of R1 000 in the Pietermaritzburg Magistrate’s Court.

The court found that the man is a not a flight risk and that the child has been removed to a place of safety.

In an affidavit filed in support of his bail application the accused — who cannot be named in order to protect the identity of the alleged rape victim — said he supports his wife and two children and is caring for his mentally disabled brother.

The man said he denies the allegations and intends to plead not guilty.

Investigating officer Wiseman Ngcobo opposed the granting of bail and expressed fears that if released his life would be in danger as the community wants to kill him.

He said it was alleged the man raped the child in front of her mother. Evidence linking the man to the offence consisted of the “victim’s statement” and medical evidence that “does not exclude the sexual assault”.

He said there is still a statement needed from a teacher.

The Witness questioned recently why the mother was not also charged as she was allegedly present.

Warrant Officer Joey Jeevan said in response that her involvement at this stage was “only hearsay evidence”.
