Forum tries to lay charges against owner of Field’s Hill death truck

MAZIBUYE African Forum say they will be meeting with their lawyers this week after allegedly being turned away by Pinetown police when they tried to open a case against Gregory Govender, owner of the truck involved in the Field’s Hill crash.

Govender’s driver Sanele May was driving when his vehicle slammed into taxis and cars, leading to 24 deaths.

Mazibuye spokesperson Phumlani Mfeka said it was unfair that May was the only one facing murder charges.

Mfeka told The Witness they were prevented from opening a case because “the investigation was still ongoing”.

“But we’re arguing that the investigation can still go on while the truck owner is charged,” he protested.

ADR Network, a private alternative dispute resolution agency, said the forum was intending to lay 24 charges of murder and/or alternatively culpable homicide and one charge of defeating the ends of justice against Govender, the owner of Sagekal Logistics.

Sheena Jonker of ADR Network said the forum was within its rights to open charges against Govender and his company.

Govender’s spokesperson Lisa Sukdev said Govender had no comment. Sukdev said only the National Prosecuting Authority can bring charges against Govender and if they do, he will deal with them like anyone else and follow due process. Police had yet to respond to Witness queries .
