Girls (13) could face statutory rape charges

Two 13-year-old Free State girls may become the first in the country to be charged with statutory rape following a recent amendment to the Child Act.

The amendment provides that not only men or boys, but all parties involved in statutory rape, can be charged. The girls had sex with boys aged 15 and 16, who will face the same charge.

The girls and one of the boys, who are from a children’s home, met the second boy and went to a pub, where they were served liquor. The police have reported the bar to the liquor board.

The four then allegedly went to one of the boys’ parents’ flat. The parents were absent.

One of the girls apparently had sex with both boys, while the other girl had sex with only one.

Inspector Richard Botha of the child protection unit said all the parties will now possibly be charged with statutory rape.

This would be in terms of Act 32 of 2007, Section 16 [the new act], which provides that not only “male parties”, but “all parties”, may be charged.
