Greytown murder case: men refused bail after declining to testify

AFTER submitting bail applications on affidavit, three Durban murder and robbery accused were denied bail by Pietermaritzburg regional magistrate T.N. Mncube yesterday.

Mncube said that by submitting affidavits instead of giving oral evidence, the accused precluded the state from cross-examining them and eliciting additional information required.

The accused are Mondli Zuma, Sifiso Mazibuko and Simphiwe Cebekhulu, who are charged with the murder of Greytown businessman Mohammed Sayer (35), who was found shot dead in his bed on the night of June 1. A firearm was found between his legs. A fourth accused, Thokozani Mzila, did not apply for bail.

Mncube said the accused did not give evidence of exceptional circumstances needed to justify bail in very serious cases.

The accused are also charged with the murder of one of their alleged gang, Mandla Majola, who was dressed in a police uniform and was believed to have been wounded in a shoot-out in Sayed’s house.

Investigating officer Inspector Swami Pillay said a co-perpetrator has agreed to testify for the state. He said one of the bail applicants, Mondli Zuma, has “come clean” and given information.
