IFP asks ConCourt to dismiss claim

THE Inkatha Freedom Party has asked the Constitutional Court to dismiss an application by an independent candidate wanting the party and the ANC to be fined and not be allowed to contest by-elections in Abaqulusi Municipality’s ward 22.

This emerged in court papers filed with the Constitutional Court after former ANC councillor André Lotter approached the court to appeal an earlier ruling of the Electoral Court in April.

The Electoral Court stopped the by-election and ordered the Independent Electoral Commission (IEC) to institute an investigation after Lotter claimed the ANC and IFP had bused in people to register in Ward 22.

Lotter subsequently lodged another application in the same court and the Constitutional Court.

The Constitutional Court interdicted the August by-elections and gave the IEC, ANC and IFP until last Tuesday to make submission on why the matter should not be referred back to the Electoral Court and on penalties imposed on the two political parties.

In his application, Lotter wants penalties — R200 000 fines and that they not contest the by-elections — imposed on the ANC and IFP. He also wants an independent commission of inquiry headed by himself to probe voter registration in Ward 22, saying the one done by the IEC was inadequate.

However, the IFP denied it was involved in any form of electoral fraud in the run-up to the Abaqulusi by-election.

The party said Lotter’s application to the Constitutional Court amounted to abuse of court processes and sought to seek relief from unfinished business of the Electoral Court.
