Jail term to stand for teen killer of farmer

THREE high court judges of appeal on Friday confirmed the conviction and effective 24-year jail sentence imposed on the 18-year-old killer of Estcourt farmer David Green (70), who was shot dead on December 20, 2007.

Green’s assailant, Nkosithemba Ntshaba, pleaded guilty to the murder in 2008.

His gulilty plea and his youth were considered by high court judge Piet Koen to be reasons not to impose life imprisonment on Ntshaba.

In a statement to the trial court, Ntshaba said he decided to go to Green’s farm to steal out of “sheer desperation” because his father did not have money that day to buy himself the medication he needed to treat a permanent skin disorder that became unbearably itchy.

On the day of the murder Ntshaba armed himself with an unlicensed 9 mm pistol that had legally belonged to his late grandfather and a single live 9 mm round.

At the farm he said he was confronted by Green, and he pointed the gun at him and demanded money.

“The deceased then called for his dogs. I then panicked and fired a shot at him. The bullet struck him in the head and he fell to the ground.”

Afterwards, he went into the kitchen and stole two cellphones before fleeing.

According to the state’s indictment, Green was shot from behind.
