Judge cancels bail for missing accused

PIETERMARITZBURG regional court magistrate Riaan de Wet yesterday finally cancelled the bail of alleged “five minute gang” member Mdeni Vilakazi, who has absconded and is being sought by the police.

Vilakazi failed to appear in court when the trial was due to start on September 26 and a provisional warrant for his arrest was issued. He was again not present yesterday.

The state has indicated that it will proceed to trial against Vilakazi’s three co-accused — Jabulani Radebe (35), Ntokozo Majola (32) and Sibongiseni Zwane (31) — who were in court. However a date for the trial will have to be finalised with their advocate, Jimmy Howse.

The charges against the accused date back to early 2008.

The state alleges that they were part of a gang which was dubbed the “five-minute gang” because of the speed with which they succeeded in robbing several houses in Pietermaritzburg’s upmarket suburbs between February and May 2008.

The four accused were arrested after Majola’s dark green BMW X5 collided with a Chubb security vehicle and items allegedly linked to the robberies including a crowbar, hammer and allegedly stolen watches were reportedly found in the vehicle which had false numberplates. The accused were initially denied bail by Pietermaritzburg magistrate, Sello Maboee, but subsequently got bail after appealing to the high court.
