Judgment reserved in MEC lawsuit

Pietermaritzburg high Court judge Jan Hugo has reserved judgment in a lawsuit in which Finance and Economic Development MEC Dr Zweli Mkhize is suing City Press newspaper for R300 000.

Mkhize alleges he was defamed by an article published last March in which reference was made to allegations that emerged in the high court seven years earlier that he offered to pay R200 000 for the murder of expelled ANC Richmond leader Sifiso Nkabinde.

He complains the article did not contain the qualification that the witness who gave this evidence, Bruce Mhlongo, conceded he had never spoken to Mkhize and that it was hearsay.

City Press contends that the reporting was responsible in the context of the article, that what was published was “in error” and was “either careless or negligent but not done with malice”.

The court heard that City Press has tendered an apology to the MEC, which has been accepted.
