Knife man sentenced to 15 years

A 21-YEAR-OLD man from Impendle, Thabani Xaba, was jailed effectively for 15 years after he admitted taking part in the robbery, with aggravating circumstances, of three schoolteachers at Mazwendoda High School on the night of February 17 this year.

Acting Judge Sipho Ngwenya said he could find no compelling or substantial circumstances that would justify the court imposing less than the prescribed minimum of 15 years’ imprisonment on Xaba for each of the housebreaking and robbery charges.

Because the incidents were all committed together, he ordered that the sentences run concurrently.

Xaba admitted in a statement that he carried a knife when he entered the homes of teachers Dennis Sibisi, Sphakamiso Ndzama and Andiswa Xuba and robbed them of goods including cellphones, keys, a watch, wallet and a leather jacket.

Xaba said he and two friends, “Thula and Mondli”, armed themselves with knives and a firearm and shot at the door when Sibisi refused to open to their knock.

Acting Judge Ngwenya said he agreed with Xaba’s lawyer, Kelvin Singh, that Xaba demonstrated remorse by confessing his involvement to a magistrate immediately after his arrest. He said, however, that he believes Xaba poses a danger to the victims.
