Lucky Moloi avoids time in prison

FORMER uMgungundlovu district councillor and high-ranking ANC official Lucky Moloi (48) will not go to jail for committing corruption in 2003, and he yesterday continued to maintain his innocence.

Regional magistrate Jaco Jordaan handed Moloi a wholly suspended sentence of eight years’ imprisonment, but also ordered that he must undergo 36 months under correctional supervision, including house arrest.

For the first 12 months, Moloi will also have to perform 16 hours per month of “unremunerated” community service.

During his period of correctional supervision, he must refrain from using alcohol or drugs and will undergo rehabilitation programmes.

His lawyer, Simphiwe Moloi, confirmed that they will appeal Moloi’s conviction for corruptly arranging to be paid a R200 000 commission for influencing the municipality to buy MIB House in Langalibalele street at an inflated price of R6 850 000 in 2003. They would, however, not appeal the sentence, he added.

Though smiling broadly after the proceedings, Moloi said he would not say he was relieved by his sentence because he maintains he is not guilty of a crime. He was also confident that his position in the ANC, as a regional secretary, would not be affected.

Moloi was the only one of those involved in the corrupt act to be brought to book.
