MEC Radebe’s bodyguard to argue for bail next week

The VIP Protection Unit member charged with shooting at a vehicle on the N3 near Ashburton, which caused an accident and injured eight people on November 15, is expected to appeal to the Pietermaritzburg High Court some time next week against the decision of Camperdown magistrate, Thys Taljaard, to deny him bail.

The Witness has confirmed that papers have been filed with the high court in that regard, but the date for the hearing of the appeal has yet to be finalised.

Meanwhile, the accused, Constable Hlanganani Nxumalo (28), made another brief appearance in the Camperdown Magistrate’s Court yesterday, where he was remanded in custody until January 15. He lodged a bail application at his previous appearance before Taljaard on November 19, but bail was refused.

Taljaard said in his judgment that a message should be sent to police officers who deemed themselves to be above the law that they are not automatically entitled to bail. He found that Nxumalo had not discharged a legal onus on him to show that his release on bail was in the interests of justice.

Nxumalo maintained in an affidavit that he had co-operated fully with the police investigation into the incident and had handed himself over to police.

But the investigating officer said police had traced the registration number of the black VW Golf in which the VIP Protection Unit members were driving and which was noted down by motorists who witnessed the incident. They discovered the vehicle was that of bodyguards of MEC Meshack Radebe, and contacted the MEC.

The MEC later that day brought Nxumalo to Camperdown police.
