Magistrate: theft appeal judgment reserved

HIGH court judges of appeal in Pietermaritzburg yesterday reserved judgment on an appeal by former Pinetown magistrate Mbongeni Mathe against his conviction and sentence for theft.

Mathe was sentenced to three years’ imprisonment in terms of legislation that requires him to serve a sixth of his sentence in prison, before qualifying for correctional supervision.

In June 2007 Mathe was convicted by a Durban regional magistrate of having stolen R11 000 from a deceased estate.

Mathe’s defence was that he had deposited R10 000 of the money with a court clerk who had disappeared with it. He denied having received an additional separate “interest” payment of R1 200 from a state witness.
