Missing son: Court rules in favour of dad’s search

A MAN succeeded yesterday in obtaining a high court order which could help him find his missing son, who was allegedly abducted and taken out of the country by his ex-wife in 2008.

The parties cannot be named because the case concerns a custody dispute.

In terms of an order granted by Judge Trevor Gorven, the department and director-general of Home Affairs, as well as the minister for international relations and co-operation were obliged to provide the man, or his attorney, with information about any attempts to renew the child’s passport or obtain a visa or other travel document for the boy.

They must also inform them if the boy and/or his mother re-enters South Africa.

The child’s father lives in Johannesburg, but his ex-wife’s family resides in Pietermaritzburg.

The father alleged in court papers that his ex-wife had left the country with their son on November 17, 2008, without his consent and after forging his signature on a passport application for the child.

He was unable to determine where she had taken the boy and has searched in vain for him since then.
