Municipal manager scoffs at demands to resign

THE manager of uMdoni Municipality, Xolani Luthuli, yesterday laughed off demands by the interest group Afriforum that he step down either as the manager or from the ANC regional leadership.

“I am not breaching any law. If there is an issue with my performance that I am not providing services to the DA, the IFP and the National Freedom Party, then there is a point for me to be disciplined,” Luthuli said.

He was reacting after Afriforum sent a letter to the uMdoni municipal speaker and MEC of Co-operative Governance and Traditional Affairs, Nomusa Dube, demanding Luthuli resign either as municipal manager or as ANC Lower South Coast regional executive committee member.

Afriforum based its demand on the Municipal Systems Act, amended in 2011, which bars an office bearer of a political party from holding the municipal manager post. However, the act refers to an office bearer who is a chairperson, deputy chairperson, secretary, deputy secretary or treasurer.

Afriforum claimed that the ANC website showed that Luthuli was still the deputy secretary of the ANC region. In a statement, Afriforum branch chairperson Chris Fourie said the interest group had in March demanded Luthuli’s resignation as deputy regional secretary when he was community service general manager.

“It is extremely presumptuous of the ANC-led council to appoint their comrade knowing he is still in breach of the Municipal Systems Amendment Act,” Fourie said.

“Municipal officials are representatives of the entire community and may not serve the interests of a particular political party at the cost of certain groups or residents.”

But, ANC regional secretary Mzwandile Mkhwanazi said Luthuli was no longer an office bearer after he resigned from the position late last year long before he took up the position as manager of the uMdoni Municipality.
