Murder trial against cop postponed

2013-03-07 00:00

A DURBAN policeman, charged with shooting dead a robbery suspect who had allegedly been restrained, appeared in the Pinetown regional court yesterday.

Captain Justice Dladla made a brief appearance and his matter was postponed to May 7. Dladla faces a charge of murder and one of defeating the ends of justice.

The Independent Police Investigative Directorate (Ipid), which investigates police brutality, alleges Dladla (42) shot and killed a suspect who had already been “neutralised” after a vicious shootout that took place at a KFC outlet in New Germany in October last year.

Detective Constable Ajith Krishanlal was killed, while his colleague, Detective Constable Jerome Ngoma, survived being shot four times.

Ipid later laid the charges against Dladla. Spokesperson Moses Dlamini was quoted earlier saying: “At the time, it was reported that the robber was shooting at the police captain. An investigation was conducted and it has revealed that this version was false.”

State prosecutor Stanley Miloszewski said the office of the director of public prosecutions (DPP) would now make a decision on the murder charge.

He said the DPP will also decide whether to move the matter to the Durban High Court or to keep it in Pinetown.

Dladla’s lawyer, Sifiso Sithole, declined to comment.

“He doesn’t want to engage with the media, so let us leave it at that,” he said.

At Dladla’s first appearance in January, Sithole told the court that the shooting took pla-ce while his client was on duty.

The family of Krishanlal lambasted the state for pressing charges against Dladla, arguing that he was doing his job under strenuous circumstances.
