Nabolisa 'a very illegal alien'

ALLEGED Nigerian drug lord Frank Nabolisa (42) has contravened Home Affairs laws and regulations at least five times, the department’s assistant director, Willem Vorster, has revealed.

Vorster deals with the removal of aliens; an affidavit he prepared is part of the state’s reply to Nabolisa’s application for bail in the high court in Pietermaritzburg, which is set down for Thursday.

Nabolisa’s co-accused, Sheryl Cwele (40), of Port Shepstone, wife of State Security Minister Siyabonga Cwele, was granted bail of R100 000 on February 5. The bail was paid on the same day.

Because Nabolisa’s application is in an affidavit form, he cannot be cross-examined about it. Had he chosen to give oral evidence, he could be cross-examined.

Vorster lists Nabolisa’s contraventions of Home Affairs laws as:

• Entering South Africa clandestinely several times — despite his name being listed by Interpol for arrest in any country

• Staying in South Africa by using a false identity document. The maximum penalty is four years’ jail or R80 000 fine.

• Obtaining an ID document with false particulars (five years’ jail or R100 000)

• Obtaining a South African passport with false particulars (five years or R100 000)

• Fraudulently obtaining South African citizenship (eight years’ jail or R160  000).

Nabolisa says he is a productive member of society with four properties registered in his name and he has interests in several entities.

Vorster says an illegal foreigner may not acquire fixed property or do business in South Africa.

Superintendent Izak Ludick, the investigation officer in the case, says that Nabolisa had 10 bank cards, including one from the Bank of China and two gold cards.

Income tax officials say Nabolisa bought properties worth R2,3 million between 2001 and 2006.

He registered for income tax only in 2007 and the only income he declared was R26 000 in 2006. This entity has an outstanding tax debt of R9 274.

His taxes due to SA Revenue Service with penalties are R82 545 in 2006, R993 252 for 2007, R869 109 in 2008 and R1 124 157 in the 2008 tax year.
