No leave to appeal for fraudsters

PIETERMARITZBURG couple Dinesh Lutchman and Akashnee Singh were yesterday refused leave to appeal against their conviction and sentences for fraudulently depriving Rowena Padayachee of her Burger Street house.

The couple were each sentenced to eight years imprisonment, of which half was conditionally suspended by regional court magistrate Chris van Vuuren in December last year.

The court found them guilty of presenting a fake deed of sale to an attorney in an attempt to illegally take transfer of the property which they were renting at the time.

After the couple was jailed, Padayachee eventually succeeded in reclaiming possession of the house which she had inherited from her mother.

Dismissing the couple’s application for leave to appeal yesterday, Van Vuuren ruled that no other court would have come to a different finding in the case.

Lutchman and Singh said they now planned to petition the judge president for leave to appeal, and asked for bail pending the petition.

Lutchman told the court that they have been told they will be eligible for release in February next year, but that if any legal applications are pending they will no longer qualify.

Van Vuuren declined to comment, and advised the couple to seek legal advice.

He declined to grant them bail.
