Oscar’s brother ‘regrets’ fatal road accident

THE woman killed in an accident involving Carl Pistorius was Marietjie Barnard (36).

The charge sheet alleges that Pistorius (28), older brother of Oscar, overtook a car where it was not safe to do so on Barrage Road between Vanderbijlpark and Vereeniging on March 8, 2008.

Barnard was riding a motorbike and was severely injured in a collision with his Ford Ranger. It is not clear how the collision occurred.

Barnard died in hospital six days later.

National Prosecuting Authority spokesperson Medupe Simasiku said yesterday the case was scrapped from the roll shortly after the incident for lack of evidence.

The NPA continued the investigation, and when new evidence came to light, a warrant for Pistorius’s arrest was issued in March last year.

Simasiku said the police tracked down the outstanding evidence, such as the postmortem report and details of the accident, at the Metro Police headquarters last year.

The police now have enough evidence to prosecute Pistorius and the case was set down to begin last Thursday.

However, because of Oscar’s bail hearing, his lawyers applied for a postponement until March.

Andrew Fawcett, Carl’s lawyer, said he was released on warning.

Kenny Oldwage, Oscar’s lawyer, said in a statement on Sunday that “Carl regrets the incident”.

He added that blood tests at the time showed no alcohol in Carl’s blood.

“There is no doubt that Carl is not guilty and the charge will be fought in court,” the statement read.

The case has been set down for March 27 and 28 in the Vanderbijlpark Regional Court.

The police could not supply any information about Barnard or her family. “That should all come out in the court case,” said Simasiku.
