Guthree, whose company trades as Acutts Real Estate Agents in Pietermaritzburg and Hilton, accepted responsibility, but told the court the failure to submit a

necessary audit report in time was the fault of the firm of auditors he instructed to deal with the

book work.

Guthree said there was “nothing untoward” in his accounting records, no shortfall of any money in his trust account and that no client suffered any prejudice.

In mitigation of sentence his attorney, Siva Chetty, raised recent media reports indicating that up to 47 000 estate agents throughout the country are forced to work without valid fidelity fund certificates, allegedly due to the inefficiency of the Estate Agency Affairs Board.
