PMB judges too lenient?

SOUTH Africans Against Drunk Driving (SADD) yesterday called on Pietermaritzburg judges to pass stiffer sentences against drunk drivers.

SADD founder Caro Smit was speaking at the official launch of the campaign to name and shame drunk drivers.

She said her organisation is concerned that while a large number of drunk drivers were caught and sentenced in Pietermaritzburg last year, none of them had lost their licences or had them suspended.

The Transport Department launched a campaign to embarrass drunk drivers in October last year, and yesterday 55 names of convicted motorists were released to the media. A list will be released every month.

Of these, 50% had their licences suspended — but only three of these were from Pietermaritzburg, which had 28 people on the list.

Most of the drivers on the list will be caught unawares as the department said it has not informed them about their pending humiliation.

The list shows that the fines vary widely — R1 000 to R20 000, with licences suspended. The law provides for the department to impose fines up to R120 000.

The lightest sentence for a Pietermaritzburg man was imposed on Mthokozisi Ndlovu (27). He was caught with an alcohol level of 0,26 mg and fined R3 000 and his licence endorsed.

The heaviest sentence was passed on T. Ndlovu (47) from Dundee. He was sentenced to four years in prison and his licence was cancelled.

Smit said that she is very concerned that it seems that motorists caught driving over the limit in Pietermaritzburg are getting away with murder.

She added that “not one of them had lost their licence even though the law allows for that”.

It is encouraging that other magistrates in other parts of the province are applying the letter of the law by suspending and removing licences, Smit said, and she hopes the Pietermaritzburg judges will follow suit.

MEC for Transport Willies Mchunu said the department has decided to release the names because it is clear that violations of traffic laws are not being taken seriously.

“We have found that one thing that stops people from driving under the influence of alcohol is that they are afraid of the legal repercussions of their actions.”

Mchunu said that from December 1-31 last year 416 drivers were caught driving under the influence while in January 215 drivers were caught, a figure which he said is unacceptable.

He said the motorists whose names were released yesterday will suffer exposure and humiliation, and in some cases, their superiors would find out that they had been driving company vehicles while under the influence.
