Passenger sues Roadlink

ANOTHER civil claim has been launched in the high court in Pietermaritzburg for damages against SA Roadlink Passenger Services (Pty) Ltd by a passenger who was travelling on a bus that crashed on the N3 near Liberty Midlands Mall on December 24, 2006.

A previous claim by Wellington Manana of Orlando East, Gauteng, was settled in September last year after a number of witnesses gave evidence in a civil trial before Acting Judge Adrian Rall. Roadlink declared at the time that it agreed to settle the matter without making any admission of liability.

In the latest matter Nkosiyabo Shezi is claiming damages of R2 032 000 arising from injuries he sustained as a result of the same accident, including a traumatic brain injury, a number of fractures and disclocation of his spine and fracture of the C2 vertebra.

The bus company is defending the action, which was yesterday postponed indefinitely by agreement between the parties.

The court ordered that the costs of the adjournment be borne by the bus company, which had sought the postponement.

Gerhard Roberts SC, who appeared for Shezi, submitted that even though a day would not have been sufficient time to conclude the evidence of several experts and other witnesses he would seek to call, the case could have started.
