Payout for accident caused by roadworks

A New Hanover businesswoman, Elizabeth Rommelspacher, will be paid a total of R317 179 for damage caused to her truck and two trailers in an accident on a district road resulting from the vehicle having to avoid heaps of gravel that partly obstructed the roadway.

The accident happened almost four years ago, on September 29, 2004 on the P141 district road.

Transport MEC Bheki Cele consented to the court order, which was granted by Judge President Vuka Tshabalala in the high court yesterday.

Rommelspacher was awarded R274 580 for the damage and repairs to her Mercedes truck and two trailers and R42 599 interest.

The money must be paid to her attorneys by June 6.

According to the particulars of the claim, various gravel heaps about three metres wide caused an obstruction in the road. The truck and trailers, transporting a load of timber, had to move to the extreme left of the road to avoid the gravel.

The road surface at the edge gave way, causing the truck and trailers to topple down an embankment.
