Porritt trial: judge recuses herself

SOUTH Gauteng High Court Judge Geraldine Borchers this week recused herself as the presiding officer in the Gary Porritt and Sue Bennett fraud trial, Business Day reported.

It said the judge felt she has had too much “intimate” contact with the two accused, spanning five years, while their trial was delayed for various reasons.

As a result she formed “certain impressions that are not favourable to some of the parties” and felt it was best that she recuse herself.

Her decision resulted in a further postponement of the case to October 12 in order for the deputy judge president to assign a new judge.

Porritt and his former assistant, Bennett, are facing 3 160 charges including fraud, theft, tax evasion and infringements of the Companies Act, which potentially involve more than R200 million.

The case relates to the collapse of services company Tigon and the PSC Guaranteed Growth Fund, which wiped out investments belonging to 3 000 investors.
