Prisoners challenge visit limits

THREE prisoners serving senten­ces at Ncome Prison near Vryheid were due to apply to the high court yesterday to remove a limit on the number of visits permitted from family and friends.

The prisoners include Pietermaritzburg man Cuan McKinley (29), who was jailed for the murder of his girlfriend, Jenny Kinghorn, in 2001.

However, the case was struck off the roll when they did not appear in court timeously.

The Correctional Services Department was set to oppose the application.

The Witness has been told that, if the three men now wish to pursue the case further, they will have to apply for a new date.

Simon Zwane, McKinley and Mathews Gumede lodged an application against the minister of Correctional Services, the KZN regional commissioner of Correctional Services, the Ncome area commissioner and head of Medium B prison at Ncome.

According to court papers, the prisoners were informed at short notice on February 14 that the head of Medium B had given orders that they were not to receive visitors for the rest of the month.

Furthermore, visits to all inmates would, in future, be limited to four per month.

The prisoners submitted that they ought to have been given prior written warning and maintained the limit was “an unlawful, unreasonable and a procedurally unfair decision”.
