Province ordered to pay builder

THE high court in Durban has ordered the KZN Human Settlement Department to pay PG Mavundla Engineering close to R4 million for services, as well as the application costs.

The application was brought on Friday after the department had failed to pay the company for work at the Stepmore Project in the Sisonke District Municipality.

In an affidavit, company director Philani Godfrey Mavundla said his company took over a building project from a firm that had not delivered.

The papers show that Mavundla was approved to take over the project in March to build a community hall, creche, business centre and a sports field with change rooms.

The Witness is in possession of the approval letter, which is dated March 5, 2010, and signed by the department’s project manager and principal agent, Singatha Afrika Management Services.

There are also payment certificates issued by the same service company to the department, requesting payments to Mavundla for R3 904 348,74.

The deparment’s failure to pay resulted in PG Mavundla failing to pay taxes of R1 million due last Thursday.

Suppliers and sub-contractors were also not paid.

Human Settlement spokesperson Sureshinee Govender said the department consented to the order to pay Mavundla and paid him, but has not conceded any fault.

“Verification processes before payment takes time, especially in cases such as that of Mr Mavundla, who did work that had been ceded to him by the main contractor.”
