Pupil expulsions approved

THE KZN Education Department has given the go-ahead to Vryheid Agricultural School to expel two problem pupils.

The school had approached the high court last month to force the head of department, Dr Nkosinathi Sishi, to respond to its recommendation that the two be expelled.

In a letter attached to the court papers yesterday and dated April 8, the department informed the school’s principal, A.C. van Niekerk, that in terms of the SA Schools Act of 1996, the HOD had approved its recommendation to expel the pupils concerned.

“The approval is with immediate effect,” the letter stated.

The expulsions followed an incident where two Grade 11 pupils were found guilty by a disciplinary tribunal in September last year of smashing with a brick the windscreen of a car belonging to their English teacher. They wrote the word “leave” on the brick and left it in the vehicle.

One of the two pupils was also found guilty of bringing the school into disrepute for posting an intimidatory message about the teacher on Facebook.

The school approached the court for an order, on grounds that Sishi failed to endorse its recommendation or take any decision in the matter in the prescribed time. The chairperson of the governing body, Heinz Hellberg, said in his affidavit that Sishi’s failure to act had created uncertainty among the staff and pupils, and jeopardised their safety.

The department was ordered to pay the legal costs of the case.
