Radio: airwaves turbulent over station’s name

A JOHANNESBURG radio enthusiast, Mark Williams (56), said he was astounded when he discovered there is a broadcaster calling itself “Capital Radio 104”, which is to be launched in Pietermaritzburg, because he has registered the name.

Williams was a diehard listener of the independent Capital Radio 604 during the apartheid era and took steps to acquire the name after the station went off the air in 1996. He bought the name in 2009.

Williams told The Witness, “I own the trademark because I’m planning to revive the Capital Radio brand. I even bought the tapes, jingles, historic material and all programme recordings at the auction.”

The Witness is in possession of a copy of the certificate of registration under the Trademarks Act.

However, the managing director and founder of KZN Capital Radio 104 FM, Jerry Jones, came to the defence of his brainchild.

“The reason why we call ourselves Capital Radio is because we’re based in Pietermaritzburg, which is a capital city of KwaZulu-Natal. We want our people to have a radio station that they could be proud of.”

He added that the broadcaster’s licence is registered as “KZN Capital 104 FM” by the Independent Communications Authority of South Africa.

The station frequently uses the name “Capital Radio” in its media statements.

Martin “Gee” Godfrey of KZN Capital Radio said, “There seems to have been some confusion over Pietermaritzburg’s new radio station’s name and there has been a query from the owner of the Capital Radio 604 trademark. For the record, the station’s licence has been approved using the name KZN Capital 104 FM.”

Godfrey used to host a show called The Gee Spot on Radio Maritzburg before it closed down in 2002 and will be hosting the breakfast show when KZN Capital Radio 104 finally goes live later this year.
