Rape trialist alleges a ‘conspiracy’ against him

A MAN on trial in the Pietermaritzburg High Court in connection with the rape and robbery of four women here in January and February last year has alleged he was the victim of a “conspiracy” hatched by the rape complainants who in fact had all been his lovers.

Mlungisi Msimanga (27) of Ntabamhlophe near Estcourt told Acting Judge Ben van Heerden and his assessors yesterday that the women came to know each other through him, and said he believes they have falsely implicated him on these charges out of jealousy and because he “broke promises” to them.

“Each one of them wanted me for herself and they then got together and conspired to implicate me in these cases so that none of them will have me,” he said while under cross examination by State advocate, Suhana Singh.

He said a woman who had alleged that he had raped her after holding her up at knifepoint in Church Street and forcing her to accompany him to a bushy area on February 15 last year was in fact a prostitute whom he met while he was looking for a “body to buy” in Prince Alfred Street one night. However he said when he saw her he “loved” her and he then decided he should “propose love” to her rather than pay her for sex.

Although she accepted his love proposal, they did not have sexual intercourse that night as he had decided to “leave her out of respect”.

“I went somewhere else to buy a body for sex.”

He alleged they slept together the second time they had met and said afterwards she had become angry and had sworn at him when he refused to pay her account at a clothing store, which she had previously asked him to pay.

Asked why it was never suggested to the complainant that she was a prostitute when she met him, Msimanga said he had decided to tell the court when it was his time to testify.

Msimanga has pleaded not guilty to 11 counts of rape, robbery with aggravating circumstances and kidnapping. The State alleges one of his victims was unconscious after being given a “spiked” drink when Msimanga raped her.

The four alleged victims all identified Msimanga at identity parades as their assailant.
