Roadlink to pay R1 mln to crash passenger

A PASSENGER who suffered serious injuries when an SA Roadlink bus crashed on the N3 outside Liberty Midlands Mall on December 24, 2006, will receive R1 million in damages.

Nkosiyabo Shezi of Folweni township near Durban will be paid this sum in terms of a settlement agreement that was made an order of court in the high court in Pietermaritzburg yesterday.

In terms of the order SA Roadlink Passenger Services (Pty) Ltd must pay Shezi R100 000 before July 7, and will thereafter pay off the balance in monthly installments of R100 000. If the company fails to pay on time the full outstanding amount plus interest becomes payable immediately.

The bus company was also ordered to pay all Shezi’s legal costs to date, including the cost of obtaining expert reports from a neurosurgeon, industrial psychologist, clinical psychologist and orthopaedic surgeon.

According to the court papers, Shezi suffered a traumatic brain injury, a fractured arm and ankle, multiple lacerations and dislocation of the spine as a result of the crash.

He initially claimed damages totalling R2 032 000 from the bus company.

Shezi is the second passenger on the ill-fated bus to be offered a settlement.

SA Roadlink settled a claim by Wellington Manana of Gauteng for an undisclosed sum last September after numerous witnesses had given evidence in the trial before acting high court judge Adrian Rall.
