Shivambu snubs court

SUSPENDED ANC Youth League spokesperson Floyd Shivambu will have to pay costs after he was not ready yesterday for his Equality Court case.

He is being sued by journalist Carien du Plessis for R100 000 on a hate speech complaint.

Du Plessis alleges Shivambu called her a “white bitch” and “dumb” in an SMS last year.

At the time she was a political reporter for Independent Newpapers.

Magistrate Oriel Vele yesterday threw Shivambu a “lifeline” by postponing the case until next month.

However, he ordered Shivambu to pay Du Plessis’s legal team’s costs because Shivambu’s team was not ready to proceed, for the second time.

The case was first postponed in March.

For the first two hours of the hearing yesterday there was no sign of Shivambu or his lawyers. Eventually, an M. Mashaba arrived on behalf of Shivambu’s lawyer, Andries Nkome, but he was initially unsure if he was appearing for the applicant or the respondent.

Another hour later advocate Karabo Kgoroeadira arrived to represent Shivambu.

Kgoroeadira, clad in jeans and sleeveless top, with artificial flowers in her hair, asked Vele to postpone the case because she was “still upset” after R65 000 was stolen from her bank account.

She said she phoned Nkome early in the morning to ask him to ask Du Plessis’s legal team for the postponement.

Other reasons she gave were that she was only briefed in the case last Friday, that not all the documents are in order and that Nkome was not at court.

Du Plessis’s lawyer, advocate Richard Moultrie, opposed her application, saying that Shivambu’s legal team has had seven months to prepare.

Later, the case was postponed, with costs.
