Shot: Man gets 15 years in jail

A 28-YEAR-OLD man, Msizi Xaba, was sentenced to 15 years’ imprisonment by Judge Mohini Murugasen this week for a spur-of-the-moment murder at Mngcwini near Camperdown on December 23, 2008.

The victim, Mzwakhe Xaba, was shot during a scuffle with the accused, who had been walking along a footpath with his co-accused, Zama Mjiyakho (27), who was jailed for eight years for being an accessory after the fact to the murder, and Lucky Mkhize, who turned state witness in the case.

After being shot at close range, he was searched and his shoes, cellphone and wallet were taken.

The court found it was aggravating that the body was moved off the path after the shooting and concealed.

The victim died in hospital on December 26, 2008. — WR.
