Society wants advocate out

THE KZN Society of Advocates has asked the high court in Pietermaritzburg to strike off a Pinetown advocate, Edward Levin, who is allegedly flouting the rules of the profession.

The application, which is being opposed by Levin, has been postponed until May 21 this year for the hearing of oral evidence.

In papers before the court, the society’s chairperson, Marumo Moerane, alleges that Levin has “in a litany of instances” flouted the profession’s rules, for example, by dealing directly with members of the public, appearing as an advocate in the absence of an instructing attorney, and performing the work ordinarily done by an attorney. He has also allegedly received payment of fees and disbursements directly from members of the public, and is alleged to have misled a court during legal submissions. He said despite having been suspended previously (in January 2002) for the same conduct, Levin ignored his suspension.
