State to pay for Alex cop assault

THE state has agreed it is liable to pay damages to a Northdale resident, Mohamed Hack, who was ass­aulted in the charge office at Alexandra Road police station.

The assault occurred in front of other policemen and members of Hack’s family one night in March 2008.

In terms of a court order granted in the high court yesterday, the amount of money that Hack will be paid must still be proved or agreed on in the future.

His initial claim against the minister of Safety and Security was for R250 000 in general damages.

According to court papers, the claim arises from an incident in the Alexandra Road police station between 11.30 pm on March 23, 2008, and 1.45 am the following morning when Inspector Vis Naicker insulted him by telling him he was “stupid and a drunk” and repeatedly told him “you must shut your mouth”.

He thereafter “violently and repeatedly” slapped Hack across his face.

As a result, Hack alleges he suff­ered pain, and “blunt force injury” and abrasions to his face, was seriously insulted and psychologically traumatised by the words spoken.

The case received widespread publicity at the time after Hack released video footage of the assault that was aired on eTV.

The Witness reported in 2009 that Naicker (43) had died of what was believed to have been a heart attack the night before he was due to go on trial for the assault charge.

Senior Superintendent Henry Budhram confirmed at the time that Naicker had died and said he had fallen ill several weeks earlier. He added that it would have been speculation to suggest that his illness was stress-related.
