Teen admits to assault

A RICHARDS Bay teenager has admitted he sexually assaulted a naked and unconscious schoolgirl at an alcohol-fuelled house party.

The girl (13) was also raped and violated with a mop. The assault in March 2011 was captured on video and distributed to school friends.

A teacher found the teen near the school grounds with her body and clothes covered in blood.

Another girl, who is also a state witness and who attended the same party, was unharmed, but was allegedly so drunk she could barely walk.

Three underage teenagers along with Dean Naidoo, who is said to have provided the alcohol, Jermaine Kamraj and Sheldon Sathianathan, aged 18 and 19 years old at the time, were initially charged with rape and sexual assault.

The state then dropped and cleared all charges against Naidoo and Kamraj.

A boy and Sathianathan earlier pleaded guilty to rape of a minor. Sathianathan maintained in his guilty plea that the sex they had was consensual, which was not refuted by the victim.

The court found the boy guilty of two counts of rape, one being the violation with the mop.

Sathianathan was handed a six-year sentence, wholly suspended, three years’ correctional supervision and 16 hours each month of community work for the duration of his sentence.

The boy was sentenced to three years’ correctional supervision and a six-year sentence, wholly suspended for five years.

Both the boy and Sathianathan have since turned state witness along with the other teenage girl who was present at the party.

Yesterday another boy, known as Accused 2, pleaded guilty to sexual assault of the girl.

Standing before Magistrate T.S. Ngesi at the Esikhawini Magistrate’s Court, Accused 2 said in his statement, read out in-camera, but with the media present, that he knowingly violated the victim.

“I was at the house in Brackenham with five others [boys] and the victim and another girl. We were consuming alcohol and had a party at the house.

“I witnessed Sathianathan having sex with the complainant who was stripped naked in a bedroom. After [the sex] Dean Naidoo moved the victim from the bedroom to the garage leaving her naked body lying on the ground. I then rubbed sand all over her body and into her private parts. She appeared to be unconscious at the time,” said Acc-used 2.

Ngesi accepted the admission of guilt.

Prosector Wandi Nzimande said the National Prosecuting Authority also accepted the guilty plea.

Accused 2 was standing trial alongside another boy known as Accused 1.

Accused 1 has pleaded not guilty. He is believed to have been party to the mop incident and faces a charge of rape.

His mother, who cannot be named to protect the identity of her son, said she believes her son is innocent.

“It has been a traumatising few years. I have just placed my trust in God. My son knows he is innocent. My only concern is that the people who have turned state witness give a fair and accurate account of what happened at the party and do not try to falsely implicate my son. He deeply regrets going to the house party,” said the mother.

Sentencing of Accused 2 will take place on July 1 when a report compiled by a probation officer is handed to the court.

The trial of Accused 1 will be moved to Empangeni.
