Ten years for knife killing

TWENTY-SEVEN-YEAR-OLD Northdale man Nazeer Bux was sentenced to an effective 10 years in prison yesterday for the murder of Mohamed Vally during an incident which was sparked by a dog fight on October 29, 2010.

Bux’s attorney, Anand Pillay, will bring an application for leave to appeal Bux’s conviction and sentence on September 10.

Regional magistrate Sello Maboee yesterday convicted Bux of stabbing Vally to death with a long dagger and of assault with intent to do grievous bodily harm to Vally’s brother, Faheez.

Faheez Vally said in his evidence during the trial he had been playing “fetch” with his pitbull in the street in Ginger Road when two dogs appeared from the yard of the house where Bux’s in-laws lived. A dog fight started.

While he was trying to separate the dogs, Bux drove up, jumped out of his vehicle and “swung” a knife at him cutting his face next to his ear.

He said his brother, Mohamed, was killed trying to defend him. He told the court his brother had a “big hole” in his chest from being stabbed.

Bux’s defence was that a “free-for-all” had erupted involving a group of people, including the Vally brothers, that night and that he was assaulted and stabbed five times in the head. He denied stabbing the Vally brothers.

Maboee, however, found there was corroboration for the versions given by the three state witnesses, one of whom was independent and had no reason to falsely implicate Bux.

Passing sentence, Maboee said he took into account that Bux had also been injured on the night in question as shown in photographs placed before the court.

The incident occurred on the spur of the moment and there was no evidence it was premeditated, he said.
