Trio found guilty of gang-rape, sentenced to 20 years in jail

THREE men who robbed a couple on the N2 and gang-raped the woman on September 22 this year, were each effectively jailed for 20 years yesterday.

A fourth assailant, who was found guilty of the rapes on the grounds that he had kept watch on the freeway while his accomplices raped the woman, was given an effective 15-year term by high court judge Isaac Madondo. All four pleaded guilty, which Madondo found an indication of remorse.

State advocate Candy Kander conceded that the men’s decision to plead guilty had saved the woman from having to relive her ordeal in court, and had saved the state the cost of a lengthy trial. However, Kander said an affidavit by the woman spoke “volumes” about her psychological and emotional trauma.

According to evidence, the couple, carrying shopping bags, were waiting for transport to go home under the Umhlali bridge on the N2 at 6.30 pm when they were accosted by the men. The men said in statements read to court by their legal aid lawyer, Ishi Khan, that three of them had threatened the couple with knives and demanded valuables.

While the woman’s companion had escaped and run off to summon help, Sifiso Bomboto (25), Mzuyande Cawe (22 ) and Sivuyile Mohaphetshu (28) took turns to rape the woman, while Sibusiso Xulu (22) kept watch.
