Two cops get 15 years for fatal chase

TWO policemen were convicted and sentenced to 15 years each for murder in the Richards Bay Regional Court yesterday, after a man died during a car chase.

It is alleged that on September 16, 2009 Constable Freeman Masikane and Sergeant Bhekuyise Dladla of Hluhluwe Uniform Branch received a report of a stolen vehicle from Mkuze SAPS, and gave chase after the vehicle.

Sandile Dube (22), the driver, refused to stop and the policemen fired shots. As a result, the vehicle veered off the road and overturned. The driver and the passenger were thrown out of the vehicle, and the driver died.

The police alleged that the driver died as a result of an accident. The Independent Police Investigative Directorate took over the case and found that the police’s version was not true.

They recommended that the police officers be charged with murder or culpable homicide. The Director for Public Prosecutions agreed, and the policemen were prosecuted for murder, alternatively, culpable homicide.

Both accused were found guilty on a charge of murder and sentenced to 15 years’ imprisonment, without the option of a fine.
